OVERVIEW
These terms and conditions govern all purchases from the Technomobi Online Shop. By using www.technomobi.co.za (the "Website" or "Services"), whether as a visitor or a registered User to browse or purchase any product, you are bound by these terms and conditions ("Terms of Service" or "Terms").
The terms "we", "us" and "our" refer to EOS (Pty) Ltd trading as Technomobi, a company registered in terms of South African law (Registration number: 2015/331772/07, VAT number: 4650180831). Technomobi is powered by Shopify, which enables us to provide the Services to you.
Please read these Terms of Service carefully. By visiting, interacting with or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you should not use or access our Services.
SECTION 1 - ACCESS AND ACCOUNT
You may only purchase goods from this Website if you are 18 years or older, or with the consent of your legal guardian. By accepting these terms, you confirm that you meet this requirement.
To purchase products, you must be a registered User and be logged in with your unique details. You are solely responsible for maintaining the security of your account credentials and for all activity on your account. You may not transfer, sell, assign, or license your account to any other person.
SECTION 2 - AGREEMENT OF SALE & ORDERS
An Agreement of Sale will only be effective when the Customer electronically submits a successful order, and Technomobi has authorised and received payment. Placing a product in a shopping basket does not constitute an agreement of sale.
Technomobi reserves the right to refuse any order or process any payment for any reason, without providing the Customer with a reason. When you place an order, you are making an offer to purchase. We must receive and process your payment before we can accept your order.
Your purchases are subject to return or exchange solely in accordance with our Return and Refund Policy. You represent and warrant that your purchases are for your own personal or household use and not for commercial resale or export.

There is no minimum order value.

A maximum value of R20,000 (Twenty Thousand Rand) applies per order on Hardware purchases.
SECTION 3 - PRODUCTS AND AVAILABILITY
All products and pricing are subject to stock availability. We have made every effort to provide an accurate representation of our products. However, colours or appearances may differ based on your screen.
Technomobi makes every effort to ensure that information is accurate; however, when delays or out-of-stock situations occur, customers will be informed. If an item is ordered and Technomobi is unable to fulfil it, our liability is limited to refunding the amounts received for that product. We reserve the right to discontinue or change any product at any time without prior notice.
SECTION 4 - PRICES AND BILLING
Prices, discounts, and promotions are subject to change without notice. All Prices are VAT inclusive. The price charged will be the price in effect at the time the order is placed.
You agree to provide current, complete, and accurate purchase, payment, and account information for all purchases. You represent and warrant that (i) the credit card information you provide is true and complete, (ii) you are duly authorised to use such card, and (iii) you will pay charges incurred by you at the posted prices.
SECTION 5 - DISCOUNTED OFFERS & VOUCHERS

All voucher codes are applied to the order total, excluding delivery costs.

Unless stated otherwise, discounts cannot be combined, and only one offer can be applied per order.

Voucher codes are valid for 12 months from the date of purchase unless otherwise specified.

Items already reduced in price (displaying a 'Was' and 'Now' price) are excluded from voucher offers.

Technomobi reserves the right to change, modify, add, or remove any discount offers at any time.
SECTION 6 - SHIPPING, DELIVERY, RICA, AND TV LICENSES
All risk, including loss, theft, damage, or unauthorised use, passes to the Customer on delivery.
RICA Compliance: Due to Legislative requirements, upon delivery of a cellular device or SIM, the Customer must present the courier driver with an Original ID document/Passport and Proof of Physical Address (not older than 3 months). If the Customer cannot produce these documents, the courier driver will not deliver the products.
TV Licenses: Technomobi requires you to produce a valid TV license and ID document when purchasing a TV. You may not purchase a television set using someone else’s TV license.
SIM Card Activation: If a SIM is RICA-registered, it will automatically be activated when inserted into a device. If not registered, activation will not be allowed until RICA compliance is met. Activation on the Vodacom Network can take up to 24 hours.
SECTION 7 - BLACKLISTING OF CELLULAR PHONES
In the event of theft or loss of a Cellular phone provided by Technomobi, the Customer may request Technomobi to list the phone on the "blacklist" to prevent its further use on the Vodacom Network, provided all required information is supplied.
SECTION 8 - INTELLECTUAL PROPERTY
Our Services, including all trademarks, text, images, and designs, are owned by Technomobi, its affiliates, or licensors and are protected by intellectual property laws. These Terms permit you to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, or create derivative works without our prior written consent.
SECTION 9 - RELATIONSHIP WITH SHOPIFY
Technomobi is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with Technomobi. Shopify is not responsible for any aspect of any sales between you and Technomobi, including any injury, damage, or loss resulting from purchased products.
SECTION 10 - PROHIBITED USES
You may access and use the Services for lawful purposes only. You may not access or use the Services: (a) for any unlawful purpose; (b) to violate any regulations, rules, or laws; (c) to infringe upon our intellectual property rights; (d) to harass, abuse, or intimidate; (e) to transmit false or misleading information; (f) to upload viruses or malicious code; or (g) to spam, phish, or scrape data. We reserve the right to suspend or terminate your account for violating these Terms.
SECTION 11 - DISCLAIMER OF WARRANTIES
Whilst every effort has been made to ensure the proper performance of this Website, Technomobi does not guarantee the availability, accuracy, or reliability of the Website. The Website is supplied on an "as is" and "as available" basis. It is the Customer's sole responsibility to satisfy themselves that the service will meet their individual requirements.
SECTION 12 - LIMITATION OF LIABILITY
To the fullest extent provided by law, in no case shall Technomobi, our directors, employees, affiliates, agents, or Shopify be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including lost profits, lost revenue, or loss of data arising from your use of the Services or any products procured using the Services.
SECTION 13 - INDEMNIFICATION
You agree to indemnify, defend and hold harmless Technomobi, Shopify, and our affiliates, partners, officers, and employees from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of these Terms of Service or your violation of any law or the rights of a third party.
SECTION 14 - DISPUTES & GOVERNING LAW
This Website is hosted, controlled, and operated from the Republic of South Africa and is governed by South African law.
Save for urgent or interim relief, which may be granted by a competent court, in the event of any dispute between the Customer and Technomobi that is not resolved through our Customer Care Department, such dispute shall be submitted to confidential arbitration in terms of the Arbitration Foundation of South Africa's expedited rules. Arbitration proceedings shall be conducted in Johannesburg in English.
SECTION 15 - CHANGES TO TERMS OF SERVICE
Technomobi may, in its sole discretion, change these Terms of Service at any time. It is the Customer's responsibility to visit the Website to ensure they are satisfied with any amendments. Continued use of the Services following the posting of any changes constitutes acceptance of those changes.
